Activate & Barrel provides an AI-native sales engagement platform for B2B teams. The platform supports outbound outreach across LinkedIn, WhatsApp, and email, including AI-assisted drafting, prioritisation, conversation management, and optional CRM functionality.

Services are provided digitally via the platform and agreed online channels. We make reasonable efforts to provide the service as described but do not guarantee responses, leads, revenue, or any specific commercial outcomes.

We reserve the right to refuse, suspend, or terminate access to the service at our discretion, including where use presents legal, security, or reputational risk.

3. Business-Only Use

Activate & Barrel is provided exclusively for business customers. We do not offer services to consumers acting in a personal capacity.

By using the platform, you confirm that you are acting on behalf of a business or organisation and that consumer protection legislation does not apply.

4. Eligibility and Authority

You must be at least 18 years old and have the legal authority to enter into binding agreements on behalf of yourself or the organisation you represent.

You confirm that any third-party accounts, inboxes, or communication channels you connect are owned by you or that you have explicit authorisation to use them.

5. Pricing and Payment

Prices are listed on the website or agreed in writing and are exclusive of VAT and applicable taxes.

Payment is due in advance and must be made via accepted payment methods before service access is granted. Subscription fees are non-refundable unless explicitly agreed in writing.

Trials, where offered, are time-limited and may include feature or usage restrictions.

6. Accounts and Security

Login credentials are personal and must not be shared. You are responsible for maintaining the confidentiality of your account details and for all activity carried out under your account.

We may suspend access if we believe account security has been compromised.

7. Acceptable Use

You agree not to use the platform:

  • For unlawful, misleading, abusive, or spam activity

  • In breach of the terms of LinkedIn, WhatsApp, email providers, or other third-party services

  • To impersonate others or misrepresent affiliation or intent

  • To attempt to reverse engineer, scrape, or interfere with the platform

You remain fully responsible for all outbound messages sent through the platform.

8. AI-Generated Content

AI-generated messages, insights, and recommendations are provided as suggestions only. You remain responsible for reviewing, approving, and sending all communications.

Activate & Barrel operates a human-in-the-loop model. AI output does not constitute professional advice and should not be relied upon without review.

9. Intellectual Property

All software, platform functionality, branding, designs, and materials created by Activate & Barrel Ltd are our intellectual property and are protected by applicable laws.

You may not copy, modify, distribute, or create derivative works without prior written consent.

10. Data Protection

We process personal data in accordance with our Privacy Policy, which forms part of these Terms. By using the service, you acknowledge and agree to such processing.

11. Service Availability

The platform is provided on an "as available" basis. We do not guarantee uninterrupted access and may carry out maintenance, updates, or changes from time to time.

12. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential losses, including loss of data, revenue, or business opportunity

  • Our total liability is limited to the fees paid by you to Activate & Barrel Ltd in the twelve months preceding the claim

We are not responsible for failures caused by events outside our reasonable control, including third-party service outages or force majeure events.

13. Termination

You may cancel your subscription at any time in accordance with your plan terms.

We may suspend or terminate access if these Terms are breached or if continued use poses legal or security risk. Upon termination, access will be revoked and data handled in accordance with the Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. Updated versions will be published on our website and take effect upon posting unless stated otherwise.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
